Terms and conditions for creating profiles on the Migrart Platform
1. General provisions
These Terms and Conditions set out the rules for submitting, reviewing and publishing artist profiles on the Migrart Platform, available at migrartplatform.pl.
The Platform is operated by the Strefa WolnoSłowa Foundation (Fundacja Strefa WolnoSłowa), registered in the Polish National Court Register under KRS number 0000405137, REGON 145929290, and NIP 5242748489 (hereinafter referred to as the "Platform Administrator").
The purpose of the Platform is to showcase the work of migrant artists living in Poland, increase their visibility and help them establish connections with institutions, organisations and other individuals interested in their artistic activities.
Submitting and publishing a profile is free of charge. Submitting the form does not guarantee that the profile will be published.
2. Profile submission rules
Profiles may be submitted by adults who are migrant artists living in Poland.
The person submitting a profile (hereinafter referred to as the "Applicant") agrees to provide accurate and up-to-date information about themselves and their artistic activities.
A submission may include a description of artistic activities, a portfolio, photographs, contact details, links to a website and social media profiles, and other materials related to the Applicant's artistic work.
All information, materials and links submitted must relate to the Applicant and their artistic work. Applicants are not allowed to submit portfolios, social media profiles or other materials belonging to third parties as their own.
The Applicant is responsible for the content of their submission and for holding the necessary rights and permissions to submit materials for publication.
3. Review and publication of profiles
The Platform Administrator reviews all submissions before publication and may ask the Applicant to provide additional information or clarify the information submitted.
The Platform Administrator may refuse to publish a profile if its content is inconsistent with the purpose of the Platform, if the submission does not meet the criteria set out in these Terms and Conditions, or if it contains false information or materials that infringe the rights of third parties.
The Platform Administrator may make necessary editorial and technical changes, provided that they do not alter the meaning of the information submitted.
The Platform Administrator may hide or remove a published profile if its content is found to be inconsistent with these Terms and Conditions, the purpose of the Platform or applicable laws, or if it infringes the rights of third parties.
4. Copyright and profile promotion
The Applicant retains the copyright to the submitted materials, provided that they hold such rights.
The Applicant grants the Platform Administrator a free-of-charge, non-exclusive licence to use the submitted materials for the purpose of publishing the profile on the Platform and promoting the Applicant's profile and artistic work.
The licence covers the publication of materials on the website migrartplatform.pl, on the Platform Administrator's social media channels, and the sharing of these materials with organisations and institutions for informational and promotional purposes related to the Applicant's artistic activities.
The Platform Administrator may share links to published profiles, as well as the information and materials contained in them, with organisations, institutions and other entities interested in the work of artists.
The Platform Administrator does not acquire copyright to the materials and may not use them for purposes unrelated to the activities described above without a separate legal basis or the consent of the rights holder.
5. Profile updates and removal
The Applicant may request an update or removal of their profile by contacting the Platform Administrator at migrart.waw@gmail.com.
The Platform Administrator will review such requests within a reasonable period of time.
Removing a profile from the website does not automatically result in the removal of materials previously shared by other entities or all technical copies.
6. Personal data
Personal data submitted through the form is processed in accordance with the Migrart Platform Privacy Policy, available on the website. Acceptance of these Terms and Conditions does not replace any consent or other legal basis required for the processing of personal data or the use of a person's image.
7. Contact and final provisions
For any matters related to the operation of the Platform, the Platform Administrator can be contacted by email at migrart.waw@gmail.com.
The Platform Administrator may amend these Terms and Conditions for justified reasons, in particular in the event of changes to the operation of the Platform or applicable laws.
Any matters not covered by these Terms and Conditions shall be governed by applicable laws.
