Privacy Policy of migrart.pl

This Privacy Policy sets out the rules for the processing of personal data of users of the migrart.pl website (the “Service”) in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and other applicable laws of the European Union and national legislation.

The controller of personal data is MigrArt (hereinafter: the “Controller”).

2. Scope of Processed Data

Within the Service, users may voluntarily provide the following personal data:

  • first name and last name,
  • country of origin,
  • email address,
  • telephone number,
  • links to websites and social media profiles related to the applicant,
  • biography, description of artistic practice, visual and audiovisual materials,
  • any other data voluntarily provided through the submission form.

The Controller may also process technical data (e.g. IP address, browser data, cookies) to ensure the proper functioning of the Service.


3. Purposes and Legal Bases for Processing

Personal data are processed for the following purposes:

  1. Operating and developing the MigrArt artist database, including the publication of artist profiles on migrart.pl (legal basis: Article 6(1)(a) GDPR – consent).
  2. Contacting the user regarding their submission or matters related to the Service (legal basis: Article 6(1)(a) or 6(1)(f) GDPR – consent or legitimate interest of the Controller).
  3. Informational and promotional activities related to MigrArt’s activities (legal basis: Article 6(1)(a) GDPR – consent).
  4. Compliance with legal obligations binding on the Controller (legal basis: Article 6(1)(c) GDPR).

Providing data is voluntary; however, failure to provide certain data may prevent the publication of a profile or further contact.


4. Data Recipients

Personal data may be shared with:

  • entities cooperating with the Controller in maintaining and operating the Service (e.g. hosting providers, IT service providers),
  • accounting or legal service providers,
  • public authorities where required by applicable law.

Data may be published within the Service in accordance with the scope of consent granted by the user.


5. Transfers Outside the EU/EEA

As a rule, data are processed within the European Economic Area (EEA). If personal data are transferred outside the EEA, the Controller will ensure appropriate safeguards in accordance with Chapter V of the GDPR (e.g. European Commission standard contractual clauses).

Personal data will be retained:

  • for the duration of the profile’s presence in the MigrArt database,
  • until the user withdraws their consent,
  • for the period required by law with regard to accounting or tax obligations (if applicable).

After these periods, the data will be deleted or anonymised.


7. Rights of the Data Subject

Each individual has the right to:

  • access their personal data,
  • rectify inaccurate data,
  • request erasure of data (“right to be forgotten”),
  • restrict processing,
  • data portability,
  • object to processing,
  • withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal),
  • lodge a complaint with the competent supervisory authority (in Poland: the President of the Personal Data Protection Office).

  • ensure the proper functioning of the website,

10. Changes to the Privacy Policy

The Controller reserves the right to amend this Privacy Policy. The current version of the document is always available on migrart.pl.
